1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of this website, operated by LanTing ("we", "us" or "our"), and any products, quotations, information or services made available through it.
By accessing, browsing or using this website, you confirm that you have read, understood and agreed to be bound by these Terms. If you do not agree, you must stop using the website immediately. If you use the website on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
2. Use of the Website
You may use this website for lawful business purposes only. We grant you a limited, non-exclusive, non-transferable, revocable right to access and view the website and to submit legitimate business inquiries.
You are responsible for ensuring that your use of the website complies with all laws and regulations applicable in your jurisdiction, including laws relating to international trade, advertising and data protection.
We reserve the right to suspend, restrict or terminate access to the website at any time, without notice, where we believe these Terms have been breached or where required by law.
3. Product Information
We make reasonable efforts to describe our products, including new and used construction machinery, accurately. Descriptions, photographs, specifications, working hours, year of manufacture and condition reports are provided for general guidance and may be based on information supplied by manufacturers, suppliers or previous owners.
Used machinery is, by its nature, subject to wear and may show signs of previous use. Minor variations between the description and the delivered machine may occur. Unless expressly agreed in writing, product listings do not constitute a binding offer and should not be relied upon as a guarantee of any specific characteristic.
It is the buyer's responsibility to verify that the equipment is suitable for its intended application, complies with local emissions, safety and technical requirements, and can be legally imported and operated in the destination country.
4. Quotations and Orders
All quotations issued through this website or by email are valid for the period stated in the quotation, or if no period is stated, for seven (7) calendar days. Quotations are subject to stock availability, currency fluctuations and supplier confirmation.
An order is only binding on us once we have issued a written order confirmation and, where required, received the agreed deposit or full payment. Until that point, we may decline or cancel an order at our discretion.
Any request to amend or cancel an order after confirmation must be made in writing and is subject to our approval and to any costs already incurred, including inspection, refurbishment, packing or freight costs.
5. Prices and Payment
Prices are quoted in the currency stated in the quotation and, unless otherwise agreed, are exclusive of freight, insurance, customs duties, taxes, port charges and any other costs associated with export, import or delivery.
Payment terms are set out in the applicable quotation or sales contract. Where a deposit is required, production, preparation or shipment will not commence until the deposit has been received in cleared funds.
Bank charges and currency conversion costs are the responsibility of the payer unless otherwise agreed in writing. We are not responsible for delays caused by payment processing, banking compliance checks or currency controls.
6. Shipping and Delivery
Delivery terms are governed by the Incoterms stated in the applicable quotation or contract. Where no Incoterm is specified, delivery shall be deemed to take place at our designated loading point.
Shipping dates are estimates only and may be affected by vessel availability, port congestion, weather, customs inspections, holidays or other events beyond our reasonable control. Delays of this nature do not entitle the buyer to cancel an order or claim compensation unless expressly agreed in writing.
Risk in the goods passes in accordance with the applicable Incoterm. Buyers are responsible for arranging insurance unless we have expressly agreed to do so.
7. Inspection and Warranty
Where inspection is permitted, buyers should arrange inspection before shipment. Once equipment has been loaded and shipped, it is presumed to conform to the agreed specification unless a written claim is submitted within the period stated in the sales contract.
Warranty terms, if any, are set out in the applicable sales contract. Used machinery is generally sold on an "as is, where is" basis unless a specific warranty has been agreed in writing. Wear parts such as filters, belts, hoses, tyres, batteries and brake components are typically excluded from warranty coverage.
Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded or limited under applicable law.
8. Export Control Compliance
Buyers and users of this website must comply with all applicable export control, sanctions, anti-bribery and customs laws.
You agree not to use this website or any product obtained through it in violation of applicable export control laws, economic sanctions, embargoes or trade restrictions imposed by the United Nations, the European Union, the United States or any other relevant authority.
You represent that you are not located in, organised under the laws of, or acting on behalf of any person or entity subject to trade sanctions, and that the equipment will not be re-exported, diverted or used for prohibited purposes, including military end-use where such use is restricted.
We reserve the right to request end-user information, refuse or cancel any order and report suspicious transactions where we consider this necessary to comply with applicable law.
9. Intellectual Property

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or any transaction conducted through the website shall not exceed the total amount actually paid by you to us for the specific product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded or limited by law.
15. Indemnification
You agree to indemnify, defend and hold harmless LanTing and its directors, officers, employees, agents and partners from and against any claims, liabilities, damages, losses, costs and reasonable legal fees arising from your breach of these Terms, your misuse of the website, your violation of any law or regulation, or your infringement of any third-party right.
We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in defending that matter.
16. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.
The parties shall first attempt to resolve any dispute through good-faith negotiations. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts of [Jurisdiction], or to arbitration in accordance with the rules specified in the applicable sales contract.
Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction where necessary.
17. Changes to These Terms
We may revise these Terms at any time by updating this page. The "Last updated" date at the top of the page indicates when the most recent revision took effect.
Your continued use of the website after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically. If you do not agree with the revised Terms, you should stop using the website.
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
